Once a divorce action has been commenced, your attorney may recommend that you hire one or more experts to assist you in valuing marital assets and giving expert testimony. While the expense of these experts may seem overwhelming, be aware that in many cases, the services and testimony of an expert may be vital to your case. I have had many clients complain to me about the cost and/or necessity of a particular witness. In most cases the services of a qualified expert not only helps prepare the case for trial but in many situations aids in avoiding a trial altogether.

Expert reports and testimony can aid your case in a variety of ways. If you live in a “fault” state, you may have to hire the services of a private investigator to compile proof of your spouse’s infidelity or marital wrongdoing. If your case results in a trial on the issues of grounds for divorce, perhaps nothing is as damning as the testimony and proof of a private investigator regarding the antics of your estranged spouse.

In all matrimonial actions, marital assets and property must be divided. Experts are commonly hired to prepare appraisals of assets such as homes and collectibles as well as valuations of more complex assets such as pensions and degrees. Many are shocked to discover how much value may be assigned to such assets.

If your attorney elects to hire experts to assist you in either preparing or presenting your case, you should first speak in depth with your lawyer about they type of information she is hoping to obtain from the expert. You should then ascertain how much assistance the expert will need from you to prepare the necessary valuation. Be prepared to provide the expert with any information or documentation he or she requires.
