Kentucky Child Custody



Kentucky child custody may awarded to either party based upon the best interests of the child. Best interests are determined based upon the following:
  • the preference of the child;

  • the wishes of the parents;

  • the child's adjustment to his or her home, school, and community; 

  • the mental and physical health of all individuals involved; and

  • the relationship of the child with parents, siblings, and other significant family members.  

Marital fault or other conduct that does not affect that parent's relationship with the child will not be considered a factor in determining Kentucky child custody. Similarly, if a parent has abandoned the marital residence due to physical harm or threats of physical harm by the other spouse, such abandonment will not be considered in determining custody.
