Maine Property Distribution
A Maine divorce Court will divide marital property in an equitable manner. Gifts, inheritance and property acquired before marriage are not marital property are considered "separate property" and are retained by the party who obtained the property. Similarly, any increase in the value of separate property or any property acquired in exchange for separate property will be retained as the separate property of the party who obtained the property. The Maine divorce Court will divide marital property based upon the following factors:

the contribution of each spouse to the acquisition of the marital property, including the contribution of each spouse as homemaker;

the value of each spouse's property; and
-
the economic circumstances of each spouse at the time the division of property is to become effective, including the desirability of awarding the family home to the spouse having custody of any children. Marital fault will not be considered in dividing marital property.
