Oklahoma Property Distribution


In an Oklahoma divorce, each party will retain any of his or her separate property. Separate property is

  • the property owned by him or her before the marriage; and 

  • any gifts or inheritances acquired during the marriage. 

An Oklahoma divorce court will divide all other property between the spouses in a just and reasonable manner. In dividing property, the Court will consider:

  • the way in which the property in question was held; and

  • the time and manner of the acquisition of the property.
