1.     By submitting your information to Millennium Divorce, LLP and requesting a listing as a "Listing Professional" in our database, you agree to the Terms and Conditions set forth in this listing agreement.

2.    If you are a lawyer advertising on our site, you represent to Millennium Divorce, LLP that you are a member of the Bar in good standing in the jurisdiction(s) in which you have requested a listing.  If you are a mediator, accounting professional, or other professional seeking a listing, you represent that you have complied with all licensing and certification requirements of the jurisdiction(s) in which you have requested a listing.

3.    You have reviewed your listing information and represent that it is factually accurate.

4.    Listing Professional Listings are for a period of twelve months.  Listing options are as follows:

Basic: (Lawyer Advertising Only)
No Charge
Name and address only will be listed.  No telephone, email or web site listing or linking;
One County for your State may be selected

Premium:   
Attorneys:  $165, Payable in Advance in Full for an Annual Listing for 
Divorce Mediators & Professionals:  $95, Payable in Advance in Full for an Annual Listing;
Name, address, telephone number, email and web site link;
Three Counties for your state may be selected;
Placement based upon the order in which you sign up for a listing;
Free Web Page;
Free submission of up to ten articles per year to Millennium Divorce, LLP. Millennium Divorce retains discretion with regard to publication.  Articles will be archived on the Millennium Divorce, LLP Site.

5.    The above listing packages are per professional.  If you have a need for multiple listings for your firm, contact us for special pricing information.  Special Pricing is available and is based  upon the number of professionals to be listed per firm.

6.    Millennium Divorce, LLP will update the Listing Professional's listing, including changes in name, address, phone, email, URL, and description, upon reasonable request and within a reasonable period of time after such request is made in writing.  Millennium Divorce, LLP reserves the right to decline to publish or remove all or any part of any listing at any time.

7.     Millennium Divorce, LLP may, at its discretion, add, delete, or modify these Terms and Conditions without notice. By registering for a listing in our database, the Listing Professional agrees to use the Millennium Divorce, LLP site in a manner consistent with all applicable local, state and federal laws and regulations and in accordance with these Terms and Conditions.  

8.    The Web Page services, Article submission, and content made available with our advertising packages are available FREE OF CHARGE. Millennium Divorce, LLP reserves the right to delete any page or content submitted at any time for any reason or no reason at all. Millennium Divorce, LLP may terminate any Web Page Listing (and any and all related information, communications, postings, or Web pages)  or content provided at any time, without notice, for conduct that violates local, state or federal laws or regulations, these Terms and Conditions or other policies or guidelines set out by Millennium Divorce, LLP, or for material that Millennium Divorce, LLP in its sole discretion believes is harmful to other Listing Professionals, the business of Millennium Divorce, LLP, or other third-party information providers.

9.    Millennium Divorce, LLP is not responsible for the content of any Listing Professional's Web Page or the content of any Article submitted by a Listing Professional for inclusion in our Newsletter.  The views  expressed in each of those formats are the views of and the responsibility of the posting Listing Professional.

10.    By submitting content to Millennium Divorce, LLP, the Listing Professional agrees that Millennium Divorce, LLP and it's affiliates and partners will have a non-exclusive royalty free, perpetual, irrevocable right and license to use, reproduce, modify, adapt, publish, translate, distribute, communicate, display and/or incorporate into any other works in any form, media or technology such submissions.

11.    The following is a non-exclusive list of actions and content that are prohibited on the Millennium Divorce, LLP site.  Millennium Divorce, LLP reserves the right to cancel the listing of any Listing Professional if any of the below terms are violated, with or without prior notice, in its sole discretion.

a)    The use of any copyrighted, trademarked, patented or service marked material without the express permission of the author or owner, the commission of any acts of copyright, trademark, patent, trade secret or other intellectual property infringement, or contributing to, inducing, or facilitating such infringement. 

b)    Providing material that is, in Millennium Divorce, LLP's view, grossly offensive to the Millennium Divorce, LLP Community, including, but not limited to clear expressions of bigotry, racism, or other hate speech, threats of violence, or material that defames, libels, or abuses another.

c)    The submission of content that promote illegal activity and any promotion of or provision of instructions for illegal activity. 

d)    The submission of content that contains any link to content not permitted on Millennium Divorce, LLP.

e)    The transmission of unsolicited advertising, promotional materials, or other forms of solicitation via email or news groups that lists a Member Web Page. 

f)    The development of a listing professional Web Pages that restrict access to pages through the use of password protection or other means, other than through services provided by Millennium Divorce, LLP. 

g)    The misrepresentation of a Listing Professional's identity, either to Millennium Divorce, LLP or through a submission to the Millennium Divorce, LLP site.

h)    The use of Millennium Divorce, LLP for the purpose of gathering personal identifying information from individuals or entities for commercial or unlawful purposes. 

l)    The use of any use of a listing professional Web Page, or other submitted content, in connection with "spamming" or the sending of unsolicited messages.

Millennium Divorce reserves the right to determine, it its sole discretion, if any of the above guidelines have been violated.  If, in its sole discretion, Millennium Divorce, LLP determines that law enforcement officials should be notified regarding any listing professional content, Millennium Divorce, LLP will provide that information and fully cooperate with any requests made by law enforcement officials, including providing electronic data from our server.

12.    The following limitations of liability and warranty apply to all conditions and terms between Millennium Divorce, LLP and the listing professional.

A)     The Listing Professional agrees that the use of the Millennium Divorce, LLP site, related services, and products is entirely at the Listing Professional's own risk.  This site and all related services, with the exception of the cost of an annual listing, are provided free of charge, and all services, including the annual listing, are provided without warranties of any kind.  All express, implied, and statutory warranties including, without limitation, the warranties of merchantability, fitness for a particular purpose, an non-infringement of proprietary rights, are expressly disclaimed to the fullest extent permitted by law.  To the fullest extent permitted by law, Millennium Divorce, LLP disclaims any warranties for the security, reliability, timeliness, and performance of all services offered on the Millennium Divorce, LLP site.  To the fullest extent permitted by law, Millennium Divorce, LLP disclaims  any warranties for any goods or services received through or advertised on the Millennium Divorce, LLP site or through any links provided on the site, as well as for any information or advice received through the site or through any links provided on the site. Neither Millennium Divorce nor any third party content provider makes any warranty with respect to any content, information, or services or products provided through or in conjunction with the site.  

B)    Under no circumstance shall Millennium Divorce, LLP be liable to any Listing Professional as a result of the Listing Professional's use or misuse of or reliance upon the Millennium Divorce, LLP site.  This limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, punitive and exemplary damages.  Such a limitation of liability shall apply whether the damages arise from the use or misuse of or reliance upon the Millennium Divorce, LLP site, or from the interruption, suspension, or termination of the Millennium Divorce, LLP site, or the services offered on the Millennium Divorce, LLP site.  This limitation shall apply with respect to damages incurred by reason of other services or goods received through or advertised on the site or received through any links provided on the site, as well as by reason of any information or advice received through the Millennium Divorce, LLP site.  These limitations shall apply to the fullest extent of the law.

C)    Millennium Divorce, LLP makes no implied or express representations or warranties about the reliability or accessibility of Listing Professional Web Pages, Newsletter Archives,  or  Newsletter publications.  Millennium Divorce, LLP is not responsible for any damage caused by the loss of  access to, deletion of, or failure to store, failure to back up or alteration of Listing Professional Web Pages.  Listing Professionals are responsible for monitoring and creating back ups of their pages and submissions.

14.    The listing professional agrees to indemnify Millennium Divorce, LLP against any and all claims and expenses, including attorneys' fees, arising from the Listing Professional's use of the site.  This includes, without limitation, any liability resulting from the Listing Professional's violations of the conditions of this site, including but not limited to copyright violations, the use or posting of unlawful material, and spamming.  The Listing Professional releases Millennium Divorce, its affiliates, officers and employees from any and all claims, demands, debts, obligations, damages, costs, and expenses of any kind or nature whatsoever, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, that the Listing Professional may have against them arising our of or in any way related to such disputes.  The Listing Member waives all law that may limit the efficacy of such releases.

15.  This Agreement is made in and governed by the laws of the State of New York.  Saratoga County, New York is the sole venue for any claims or actions arising out of this Agreement.  The Listing Professional agrees to personal jurisdiction in the State of New York. 

16.  This Agreement contains the entire understanding of the parties and supercedes all prior agreements, writings, emails, and facsimile's of whatever nature or number.  This Agreement may not be modified unless in writing.
